Subscription pricing, billing, renewals, cancellations, and refunds are governed by the applicable app store or payment provider and any additional subscription terms presented at purchase.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTPLAY AI LLC, ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless SmartPlay AI LLC and its affiliates from claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your infringement of another party's rights.
